  1. Introduction

These terms and conditions (the “Terms”) govern all services (the “Services“) offered on the Website www.leavethebags.com (the “Website“) excluding all other terms and conditions, except if explicitly agreed in writing by the parties.

The Website is owned and operated by Forward Initiatives SPRL, with registered office at Clos Lucien Outers, 22 box 3, 1160 Brussels, Belgium and registered with the Crossroad Bank of Enterprises under number 0806 233 514 (“leavethebags.com”, “we”, “us” or “our”).

Please read these Terms carefully. By accessing and using the Website and the Services the User is deemed to have understood and agreed the Terms. If the User does not agree with these Terms he/she should not use the Website, nor the Services.

  1. Changes to the Terms

Leavethebags.com reserves the right, at its discretion, to make changes to any part of the Website, the information or these Terms. Please review the Website periodically for changes to these Terms. The date at the top of this webpage indicates when these Terms were last updated. By continuing to use the Website and the Services the User agrees to be bound by these Terms as amended. If the User does not agree with the amended Terms, the User must not continue to use the Website, nor the Services after the date on which the amendments take effect.

  1. No Minors

The Website and the Services are only accessible to persons who are of age 18 years old (the “User”).

  1. Order requirements

The User certifies the truthfulness and correctness of all information the User provides to leavethebags.com in connection to his/her reservation.

To book our Services, the User must complete all the required fields in the online reservation form.

All payments can be done with credit cards or by using Paypal. Leavethebags.com never accepts cash payments.

The User may change his/her order at any time. If the User hands over more items than booked, he/she will be charged for the additional items. If the User hands over fewer items than booked, leavethebags.com will reimburse the overcharged items with no penalty.
All reimbursements will be handled by leavethebags.com and will never be managed on site such as at hotels, train stations or airports.

  1. Luggage Requirements

Leavethebags.com reserves the right to refuse to execute the Services without payment of any compensation in case:

  • The item or items does/do not match the order;
  • A piece of luggage contains any of the items as listed below;
  • A luggage is not in good condition for transportation, as described below.

Good condition for transportation: The User’s luggage shall

  • Be closed properly with zippers, belts or straps;
  • Be self-contained with no lose parts;
  • Be in good general condition without holes, punctures, lacerations…

Items that do not meet these conditions can be transported only if the User signs a discharge document and potentially pays an additional fee.  Explosives, firearms, flammables, tear gas, mace, pepper spray may never be transported.

Forbidden items: The User’s luggage may not contain any of the following

  • Valuables including but not limited to jewellery, china, precious or semi-precious stones, precious metals or alloys such as gold or silver;
  • Paintings, statuary, and other objects of art;
  • Documents, bills, bullion (coined or uncoined), currency, money, deeds, notes, securities, or evidences of debt;
  • Furs, fur clothing, fur-trimmed clothing;
  • Perishable goods with less than a 72-hour transit shelf life;
  • Restricted or hazardous material;
  • Contraband or property in the course of illegal transportation or trade;
  • Human remains, including, but not limited to, limbs, organs, blood, blood platelets, stem cells, or tissue;
  • Explosives, firearms, flammables, tear gas, mace, pepper spray;
  • Fragile, breakable, or temperature sensitive items;
  • Electronic or photographic equipment.

If Leavethebags.com determines that the luggage contains any of the above items it reserves the right to refuse to execute the Services without payment of any compensation.

Leavethebags.com declines any responsibility for:

  • Missing or stolen items inside unlocked or unsecured luggage;
  • Minor damages to luggage considered normal wear and tear (despite reasonable care when handling);
  • Loss or damage to prohibited luggage items, or to items packed with prohibited items and luggage containing prohibited items;

 

  1. Delivery conditions

Leave The Bags provides its luggage delivery service to and from Brussels Airport (IATA: BRU) and the Brussels-Midi international train station, also known as the Eurostar train station.

When arriving to Brussels

  1. After the User has booked the service, Leave The Bags will confirm the booking with the hotel: If the User is not the expected guest of the hotel and did not provide the name of a guest of the hotel, we will contact the User to correct the order by email or by phone. If the order cannot be corrected, we may decide with the User to cancel the order.
  2. After the booking is confirmed, we contact the user to confirm the meeting point and time.
  • At Brussels Airport: the meeting point will be in the arrivals lobby, after the luggage belts room and customs.
  • At Brussels-Midi station, there are 2 different meeting points:
    • For the Eurostar: the meeting point will be on the terrace after the train’s platform.
    • For the Thalys, ICE and TGV: the meeting point will be in the arrival hall, under the platform at the main exit.
  • If the User arrives somewhere else, we can define the meeting point as needed.
  1. At the meeting point, we may verify:
  • The identity of the User;
  • That the order matches with the luggage the User wants to entrust us with, and finally;
  • That every piece of luggage meets our conditions for transportation, as detailed in our terms & conditions.
  1. If all is well, we will place seals for each piece of luggage on the zippers, belts, straps… to ensure the luggage is not tampered.
  2. If some items cannot be transported, we will leave them with the User and provide a refund pro-rata.
  3. We will take charge of the sealed luggage and leave the airport or train station.
  4. We bring the luggage to the hotel of the User and hand it over to the concierge or to the receptionist.

SMARTFLATS Guests: All luggage are delivered directly in the flat.

  1. If a piece of luggage is not accepted by the hotel, we will contact the User to define another drop location and apply a “holding fee” of 1 euro per hour and per piece of luggage.
  2. Once the receptionist or concierge has accepted the luggage, we will notify the User, by text message or by email.
  3. Our mission is complete.

When leaving Brussels

  1. After the User has booked the service, Leave The Bags contacts the User to confirm the meeting point and time at the airport or at the train station.
  • At Brussels Airport: the meeting point will be in the departures lobby.
  • At Brussels-Midi station, the meeting point will be at the entrance of the station, by place Victor Horta.
  1. On the requested day, we will pick up the luggage of the User from the hotel after check out time – typically from 10am. We will take the luggage over from the concierge or the receptionist.
  2. If we cannot accept a piece of luggage, we will contact the User if possible and leave that piece at the hotel.
  3. We will seal zippers, belts and straps on each piece of luggage before transportation.
  4. We transport and hold the luggage until meeting time.
  5. At the meeting point, we may verify the identity of the User before handing over any piece of luggage.
  6. If all is well, we hand over the luggage to the User.
  7. If any piece of luggage is not claimed on time, we will contact the User and apply a “holding fee” of 1 euro per hour and per piece of luggage. If the User cannot come to claim the luggage, transporting it again is considered a new order.  If it cannot be delivered to a hotel, special shipping fees will be defined on a case by case basis.
  1. Cancellation

The User has the right to terminate the Services, at its discretion and without cause, within 14 days (“Withdrawal Period”) as outlined in this paragraph.

The Withdrawal Period expires 14 days after the day the User places his/her order for Services.

To exercise the right of withdrawal, the User must inform leavethebags.com of his/her decision to terminate the order by a clear statement (e.g. a letter sent by post, fax, or e-mail) before the expiry of the Withdrawal Period The User may use the model cancellation form available at the following webpage, but this is not obligatory www.leavethebags.com/cancellation.

If the User cancels his/her order completely before the pick-up time, leavethebags.com will reimburse the User’s order in full.

All reimbursements will be handled by leavethebags.com via online payment and will never be managed on site such as at hotels, train stations or airports.

The User accepts that he/she can no longer cancel the order once he/she has handed over his/her luggage to leavethebags.com or once leavethebags.com has picked it up from the hotel.

  1. No show

When arriving in town

  • If the User does not show up and the User’s flight was not delayed, leavethebags.com reserves the right to cancel the order without payment of any compensation.

When leaving town

  • If the User did not leave his/her luggage ready for pick up, leavethebags.com reserves the right to cancel the order without payment of any compensation.

 

  1. Delays

 

  • When arriving in town
    • The User has arrived but not his/her luggage: we will cancel the User’s order free of charge.
    • The User’s flight is delayed: if the User has provided his/her flight number and the original estimated arrival time, we will adjust our meeting time accordingly, or the User may always cancel the order at no charge.
    • The User missed his/her flight: the User may cancel the order or may contact us directly by phone or email to modify its order at no cost.
  • When leaving town
    • We are late: we will not make it on time with the User’s luggage.
      • We will notify the User as soon as possible and the User can decide what is best for him/her:
        • Either we agree on a new appointment time at the airport.
        • Either we ship the User’s luggage. We mutually agree where to send the User’s luggage to and leavethebags.com will then secure the User’s belongings and ship them to the agreed location within five (5) calendar days at no cost for the User.  The User’s original order will be refunded and we will offer the User a voucher to use our services for free on his/her next trip.
      • The User is late: the User must inform us as soon as possible in order to arrange a new meeting time if possible. Without news from the User we will wait until the carrier’s departure.  After that time, we will charge a “holding fee” of 1.00 (one) euro per hour and per piece of luggage.  Returning the luggage to town will be considered to be a new order and will be charged accordingly to the User.
  1. Obligations of leavethebags.com

We acknowledge that the User has and shall at all times have title to, and ownership of, his/her luggage, and that we shall have no right, title or interest in his/her luggage.

We reserve the right to outsource or subcontract all or part of the service execution, but remain liable for the proper handling of the User’s luggage and complete delivery of the service.

  1. Liability

Leavethebags.com shall use all reasonable care to protect and preserve the User’s luggage from loss or damage and shall be liable for any such loss or damage which may occur while the luggage is in our possession. The luggage is deemed to be in our possession from the moment the User hands it over to us until we hand it over to the reception at the hotel or as from the moment we pick it up at the hotel until we hand it over to the User.

Leavethebags.com shall not be liable for any loss of or damage to the User’s luggage that is caused after the luggage has been handed over to the hotel.

Leavethebags.com’s total liability arising out of or in connection with these Terms shall be limited to a thousand and five hundred euros – €1.500,00 per order.

Leavethebags.com will not be liable for loss or for damage to, or caused by, any of the items as detailed in article 5 of these Terms.

Notwithstanding the foregoing, in no event shall Leavethebags.com be liable for indirect or consequential loss (including but not limited to loss of profit, loss of data, loss of business etc.), whether in contract, extra-contractual liability or otherwise, arising out of or in connection with the use of the Services. All claims shall be initiated at the latest .

  1. Registration and deletion of an account

The User of the Website or the Services can register himself/herself by completing the online register form. Registration is personal. The User can, at any given moment, amend his/her personal page and remove himself/herself from the Website. Thus, the User should maintain his/her personal page and keep it up to date.

The User is personally responsible for maintaining the confidentiality of his/her password. This information cannot be communicated to third parties or be transmitted to them in any other way.

  1. Severability

If these Terms or any part of them should be determined to be illegal, invalid or otherwise unenforceable, then to the extent that they are so illegal, invalid or unenforceable, they shall be treated as severed and deleted from these Terms and the remaining Terms shall survive and remain in full force and effect and continue to be binding and enforceable.

  1. Force Majeure

Leavethebags.com will not be responsible for any breach of these Terms caused by circumstances beyond its reasonable control.

  1. Governing law

These Terms are subject to Belgian law and to the exclusive jurisdiction of the Belgian courts.
